The offer is conditional on signing a contract with Cornwell Photography after purchase. (full terms below) You must be willing for Cornwell Photography to use images in their marketing if they wish.

Your wedding location must be within 50 miles of Dorchester (if it is further than this please enquire as we are happy to go further but would need to charge for travel).

This voucher may not be used in conjunction with any other offer from Cornwell Photography and is not available to existing bookings.

 

1.    Reservation
The Wessex FM voucher will be taken as payment for the Booking Fee. The Booking Fee and a signed contract are required to confirm the booking. The Booking Fee secures the time and services of the Photographer.

2.    Cancellation and postponement
No refund is available in the event of a cancellation. In the case of a wedding being unavoidably postponed, there will be no additional Booking Fee providing that the Photographer can attend at the new date and time. If the Photographer is unable to attend at the new date of a previously postponed wedding the postponement will be treated as if it were a cancellation.

3.    Attendance
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances (for example but not limited to illness or bereavement), the Photographer reserves the right to appoint another suitable photographer to attend your wedding on his behalf to undertake the wedding photography to their best ability or alternatively the Client may choose to receive a full refund of money paid in such unforeseen circumstances.

4.    Limitation of Liability
In the unlikely event of photographic failure (for example but not limited to corruption of camera digital memory or mechanical failure of a camera), injury or sickness beyond the Photographer’s control, the Photographer’s liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Neither party shall be liable for indirect or consequential loss.

5.    Force majeure
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Such circumstances might include, for example, bereavement or hospitalisation of immediate family member or flooding of the venue. The Photographer will require documentary evidence to support the grounds for any such cancellation.

6.    Location Fees and Permission
The Client is responsible for all location fees and permits. The Client will need to confirm that photography is permissible during the ceremony and let the Photographer know the answer.

7.  Table Cameras
If Table Cameras are included in this contract they are on loan to the Client for the wedding. They are usually put out before the wedding breakfast and collected after the speeches. The Photographer does not ask for a deposit for the cameras whilst on loan, however if any go missing they will need to be replaced which will be charged to the Client at cost price.

8.    Images
All image sizes are nominal. The Photographer will provide a pleasing colour balance but can not guarantee exact colour matching because it is sometimes impossible to record the exact colour as seen by the human eye.

9.    Artistic Licence
The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographer’s judgement regarding the locations/poses/groupings and number of images taken and released/processed shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. The photographer reserves the creative right to edit and release only those images that he deems of an artistic standard for viewing. Such editing may for example include not showing images with blinks or inappropriate expressions.

10.    Group Formal Shots
The Client understands that the Photographer may not know the identities of guests and cannot be held responsible for any shots missed due to delay, lack of information or the actions of guests.

11.    Running to time
In any wedding there is a risk that timings will change. In the event of a section of the day taking longer than planned the Photographer may have to limit the number of photographs that can be taken at that point from those previously discussed. The Photographer will endeavour to accommodate delays over the agreed package time but reserves the right to charge for the extra hours or part-hours at the rate given above and the Client agrees to pay for all additional expenses incurred. The Client agrees that any extension of coverage is billable at the rate stated and that extra hours form part of this agreement and are subject to the same terms and conditions as found herein.

12.    Retouching and reorders
Retouching and digital manipulation is available to the Client as an optional extra.
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.

13.    Copyright and ownership
All image files remain the property of the Photographer.
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the United Kingdom Copyright and Design Act 1988 and any relevant subsequent legislation. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of the Photographer in writing.

The Client understands that they do not own the copyright in the images and waive the right to inspect or approve the finished use of the images and that the copyright of the images belongs to the Photographer as per the United Kingdom Copyright and Design Act 1988 The Photographer reserves sole right of reproduction of images except in the case where high resolution images are purchased supplied digitally via electronic media. Where high resolution images are provided as digital copies the Photographer gives the Client an irrevocable licence and right to reprint those images and distribute for personal use including use on a personal website. They may not be sold or used in any commercial publication or website without the approval of the Photographer in writing.

14.    Display
The Client gives the Photographer and its licensees or assignees absolute right to copyright and use the images and/or any other reproductions or adaptations thereof either complete or in part alone or in conjunction with any wording and/or drawings. The images may be used for purposes including (but not limited to) advertising, publicity, competition or editorial. The images may be displayed in any medium including transmission by electronic means such as the Internet.

The Client releases and discharges the Photographer and all licensees and assignees from any claims and demands arising out of or in connection with the use of the images.
Attendance at the wedding as a guest or participant in the wedding implies consent to use of photographs by the Photographer for legitimate business purposes such as those described above. It is the Client’s responsibility to ensure that parents are aware that their children may appear in wedding photographs and to indicate to the Photographer(s) if any parent refuses consent, including identification of the child to the Photographer(s).

15.    Archiving
Image files will be kept by the Photographer for as long as the Photographer requires them but no guarantee is made to the Client that they will remain available for purchase once the album or USB is delivered.

16.    Complaints
Any complaints should first be raised by the Client with the Photographer in writing within 21 calendar days from the receipt of images
